WHEREAS, Article IV, Part III of the Integrated Reorganization Plan, as approved by Presidential Decree No. 1 dated 24 September 1972, expressly provides that the "Career Executive Service (CES) is created to form a continuing pool of well-selected and development-oriented career administrators who shall provide competent and faithful service;"

WHEREAS, the foregoing law likewise created the Career Executive Service Board "to serve as the governing body of the Career Executive Service" and mandated to "promulgate rules, standards and procedures on selection, classification, compensation and career development of members of the Career Executive Service;"

WHEREAS, in accordance with the provisions of the aforementioned law, the Board passed CESB Res. No. 453 s. 2002 and a corresponding circular (CESB Circular No. 2 s. 2003) laying down the revised rules on original and promotional appointment to Career Executive Service (CES) ranks;

WHEREAS, Item B. Section 2, Article III of the afore-quoted policy expressly requires clearances from the department or agency of the CESO or CES Eligible, Civil Service Commission, Sandiganbayan, and Presidential Anti-Graft Commission;

WHEREAS, it is deemed necessary to amend the said provision to emphasize that cases against CES Eligibles or CESOs may similarly be filed at venues other than the offices afore-mentioned;

WHEREAS, in determining whether there is an administrative case filed against a CES Eligible who is candidate for original appointment to CES rank or a CESO who is a candidate for promotional appointment to CES rank, a clearance may be obtained from the Office of the Ombudsman;

WHEREAS, insofar as the criminal or civil aspect of a case is concerned, a clearance may be obtained from the National Bureau of Investigation (NBI);

WHEREAS, the Office of the Ombudsman and the National Bureau of Investigation are not among the offices mentioned under Item B, Section 2, Article III of CESB Resolution No. 453, s. 2002;

NOW THEREFORE, foregoing premises considered, the Board RESOLVES, as it is hereby RESOLVED, to amend Item B, Section 2, Article III of CESB Resolution 453, s. 2002, which reads, viz:

"Section 2. Additional Requirements for Original and Promotional Appointment to CES Ranks. In addition to the three (3) major criteria for original or promotional appointment to CES rank, a CESO or CES eligible is required to submit to the Board the following documentary requirements:

b. Clearances from the following offices:

1. Department or Agency of the CESO or CES Eligible;
2. Civil Service Commission;
3. Sandiganbayan;
4. Presidential Anti-Graft Commission;

Section 2. Additional Requirements for Original and Promotional Appointment to CES Ranks. In addition to the three (3) major criteria for original or promotional appointment to CES rank, a CESO or CES eligible is required to submit to the Board all of the following documentary requirements:

c. Clearances from the following offices:

1. Department or Agency of the CESO or CES Eligible;
2. Civil Service Commission;
3. Sandiganbayan;
4. Presidential Anti-Graft Commission;
5. Office of the Ombudsman;
6. National Bureau of Investigation;

RESOLVE FURTHER, that this resolution shall take effect after fifteen (15) days from its publication in the Official Gazette or in a newspaper of general circulation in the Philippines.
